各市、縣(xian)人民政府,省政府各部門、各直屬機(ji)構:
為貫徹落實(shi)黨的二十大精(jing)神(shen),根據《中共中央 國(guo)務院關于加強基層治(zhi)理(li)體系和(he)治(zhi)理(li)能力現(xian)代化(hua)建設的意見》《中(zhong)共(gong)中(zhong)央辦(ban)公(gong)廳 國務(wu)院辦公(gong)廳關(guan)于推進基(ji)(ji)層整合(he)審批(pi)服務(wu)執法力(li)量的實施意見》有(you)(you)關(guan)向基(ji)(ji)層放權賦能(neng)的決策部(bu)署,依據(ju)相關(guan)法律(lv)規定,決定賦予鄉鎮人民政府和街(jie)道辦事處(chu)部(bu)分縣級人民政府有(you)(you)關(guan)部(bu)門審批(pi)執法權限,以其自身名義行使。
一、積極穩妥(tuo)組織(zhi)認領承(cheng)接賦權事項。各(ge)縣(市、區(qu)(qu))要根據本地經濟社會發展情況、鄉鎮街(jie)道(dao)的實(shi)際(ji)需求和(he)承接能力,組織轄區(qu)(qu)內鄉鎮街(jie)道(dao)按照“基本盤+自選”的(de)方(fang)式,在《安徽省賦予鄉(xiang)(xiang)鎮(zhen)街(jie)道(dao)(dao)部分縣級(ji)審(shen)批(pi)執法權(quan)(quan)限指(zhi)導目錄(lu)》(以(yi)下簡(jian)稱《指(zhi)導目錄(lu)》)中(zhong)確(que)定(ding)(ding)賦權(quan)(quan)承(cheng)接(jie)(jie)事(shi)項(xiang)(xiang),經縣級(ji)人民(min)政(zheng)府審(shen)定(ding)(ding)后公布實(shi)施。基本盤內(nei)事(shi)項(xiang)(xiang)由鄉(xiang)(xiang)鎮(zhen)街(jie)道(dao)(dao)統一承(cheng)接(jie)(jie)實(shi)施,少數無(wu)實(shi)際管理對(dui)象或長期(qi)無(wu)辦件(jian)的(de),經縣級(ji)人民(min)政(zheng)府批(pi)準,可(ke)在《指(zhi)導目錄(lu)》中(zhong)調換相等數量(liang)的(de)其他事(shi)項(xiang)(xiang)。堅持應放盡(jin)放、應接(jie)(jie)盡(jin)接(jie)(jie),加(jia)強人口規模大、經濟發達等管理任(ren)務重的(de)鄉(xiang)(xiang)鎮(zhen)街(jie)道(dao)(dao)承(cheng)接(jie)(jie)賦權(quan)(quan)事(shi)項(xiang)(xiang)。各(ge)縣(市、區)要組織涉(she)及賦權(quan)(quan)的(de)縣級(ji)有(you)關(guan)部門與鄉(xiang)(xiang)鎮(zhen)街(jie)道(dao)(dao)簽(qian)訂賦權(quan)(quan)事(shi)項(xiang)(xiang)承(cheng)接(jie)(jie)確(que)認書(shu),明確(que)承(cheng)接(jie)(jie)事(shi)項(xiang)(xiang)、職責(ze)邊界等內(nei)容,確(que)保賦權(quan)(quan)工作(zuo)無(wu)縫銜接(jie)(jie)、有(you)序(xu)運行(xing)。
二、提升(sheng)基層審(shen)批服務效(xiao)能。各(ge)縣(xian)(市、區(qu))要進一步優化審批事項辦理流程,健全審管銜接機(ji)制,實(shi)(shi)現審批和(he)監管信息實(shi)(shi)時共享。建(jian)立和(he)完(wan)善適應基層實(shi)(shi)際的辦事指南和(he)工作規程,鄉(xiang)鎮街道認領承接的審批事項,進駐鄉(xiang)鎮街道便民服務中心辦理,同時落實(shi)(shi)政務服務標(biao)準化、規范(fan)化、便利(li)化要求(qiu),實(shi)(shi)行“一(yi)站式服(fu)務(wu)(wu)”“一(yi)門式辦(ban)理”,實現“就近辦(ban)、家門口辦(ban)”,提(ti)高(gao)辦(ban)事便(bian)捷度。鄉(xiang)鎮(zhen)街道要整合內部決策、管理、監督職責及力(li)量,為審(shen)批服(fu)務(wu)(wu)等工作(zuo)提(ti)供支(zhi)持和保障,更(geng)好(hao)服(fu)務(wu)(wu)群(qun)眾(zhong)、服(fu)務(wu)(wu)企業。法(fa)律規定的縣級政府及其部門的管理權限需(xu)要賦予(yu)鄉(xiang)鎮(zhen)街道的,按(an)法(fa)定程序和要求辦(ban)理。
三、實行(xing)鄉鎮街(jie)道綜(zong)合行(xing)政執法。鄉鎮(zhen)街(jie)道要(yao)按照(zhao)承接(jie)執(zhi)(zhi)法事(shi)項范(fan)圍,實行(xing)(xing)綜合行(xing)(xing)政執(zhi)(zhi)法,嚴(yan)格(ge)執(zhi)(zhi)行(xing)(xing)行(xing)(xing)政執(zhi)(zhi)法“三項制(zhi)度”、行政(zheng)處(chu)罰(fa)裁量基準、執(zhi)(zhi)法(fa)(fa)人(ren)(ren)(ren)員持證上崗(gang)等(deng)制(zhi)度,嚴(yan)格規范(fan)公(gong)正(zheng)文(wen)明(ming)執(zhi)(zhi)法(fa)(fa)。各縣(xian)(市(shi)、區)要加強對鄉(xiang)鎮街(jie)(jie)道(dao)綜合(he)行政(zheng)執(zhi)(zhi)法(fa)(fa)工作的(de)組織(zhi)協(xie)調(diao)、執(zhi)(zhi)法(fa)(fa)監(jian)督,建(jian)立(li)健(jian)全行政(zheng)執(zhi)(zhi)法(fa)(fa)協(xie)調(diao)配合(he)機制(zhi),完善評(ping)議、考核制(zhi)度。跨鄉(xiang)鎮街(jie)(jie)道(dao)地域(yu)范(fan)圍的(de)行政(zheng)處(chu)罰(fa)案(an)件(jian)(jian),以及(ji)案(an)件(jian)(jian)重大(da)復(fu)(fu)雜或(huo)鄉(xiang)鎮街(jie)(jie)道(dao)承辦(ban)可(ke)能影響公(gong)正(zheng)處(chu)理的(de),可(ke)以由縣(xian)級(ji)人(ren)(ren)(ren)民(min)政(zheng)府(fu)依法(fa)(fa)指定(ding)縣(xian)級(ji)相關(guan)部(bu)門管(guan)(guan)(guan)轄。鄉(xiang)鎮街(jie)(jie)道(dao)與縣(xian)級(ji)有(you)關(guan)部(bu)門對行政(zheng)處(chu)罰(fa)案(an)件(jian)(jian)管(guan)(guan)(guan)轄權存(cun)在爭(zheng)議的(de),可(ke)以依法(fa)(fa)提請縣(xian)級(ji)人(ren)(ren)(ren)民(min)政(zheng)府(fu)決定(ding)。公(gong)民(min)、法(fa)(fa)人(ren)(ren)(ren)或(huo)者(zhe)其(qi)他組織(zhi)不服鄉(xiang)鎮街(jie)(jie)道(dao)作出的(de)行政(zheng)執(zhi)(zhi)法(fa)(fa)決定(ding),可(ke)以依法(fa)(fa)向上一級(ji)人(ren)(ren)(ren)民(min)政(zheng)府(fu)申(shen)請行政(zheng)復(fu)(fu)議或(huo)者(zhe)向有(you)管(guan)(guan)(guan)轄權的(de)人(ren)(ren)(ren)民(min)法(fa)(fa)院提起行政(zheng)訴訟(song)。
四(si)、加(jia)強鄉鎮(zhen)街(jie)道綜合執法隊伍建設。各縣(xian)(市、區(qu))要結合實際,通過整合現有(you)站所執(zhi)(zhi)法(fa)力量和資(zi)(zi)源(yuan)(yuan)等(deng)形(xing)式,組(zu)建鄉鎮(zhen)街(jie)道(dao)綜合執(zhi)(zhi)法(fa)機構。堅持權隨(sui)事(shi)轉(zhuan)(zhuan)、人(ren)隨(sui)事(shi)轉(zhuan)(zhuan)、錢隨(sui)事(shi)轉(zhuan)(zhuan),把基(ji)層有(you)限的資(zi)(zi)源(yuan)(yuan)配備(bei)好(hao),充實基(ji)層一線(xian)執(zhi)(zhi)法(fa)力量,保(bao)障基(ji)層有(you)足夠(gou)資(zi)(zi)源(yuan)(yuan)履行執(zhi)(zhi)法(fa)職責。加強鄉鎮(zhen)街(jie)道(dao)綜合行政執(zhi)(zhi)法(fa)機構、執(zhi)(zhi)法(fa)人(ren)員(yuan)的業(ye)務指導(dao)和培訓,規范執(zhi)(zhi)法(fa)檢查(cha)(cha)、受立(li)案、調查(cha)(cha)、審查(cha)(cha)、決定等(deng)程序(xu)和行為(wei)。保(bao)持鄉鎮(zhen)街(jie)道(dao)綜合執(zhi)(zhi)法(fa)隊伍穩定,除必(bi)要崗位外(wai),應安排執(zhi)(zhi)法(fa)人(ren)員(yuan)到一線(xian)從事(shi)執(zhi)(zhi)法(fa)工(gong)作,嚴禁上級機關隨(sui)意抽調、借調基(ji)層執(zhi)(zhi)法(fa)人(ren)員(yuan)。
五、強化實(shi)施(shi)工作保障(zhang)。省(sheng)機構(gou)編制(zhi)部(bu)門要指導(dao)(dao)推(tui)動(dong)綜(zong)(zong)合(he)(he)設(she)置基層審(shen)批服(fu)務(wu)(wu)機構(gou)和組(zu)建統(tong)(tong)一綜(zong)(zong)合(he)(he)行(xing)政(zheng)執(zhi)(zhi)法(fa)(fa)機構(gou)等工(gong)(gong)作(zuo),并(bing)會(hui)同省(sheng)直(zhi)有關部(bu)門根據(ju)法(fa)(fa)律(lv)法(fa)(fa)規(gui)(gui)規(gui)(gui)章立改(gai)廢釋(shi)及鄉鎮(zhen)(zhen)(zhen)街(jie)道(dao)實際需求,動(dong)態(tai)調(diao)整(zheng)(zheng)《指導(dao)(dao)目錄》,積(ji)極推(tui)進依據(ju)人口(kou)規(gui)(gui)模數量、經濟發達程(cheng)(cheng)度等因素,分類確定鄉鎮(zhen)(zhen)(zhen)街(jie)道(dao)賦權承接標(biao)準(zhun),不斷提高賦權精準(zhun)性規(gui)(gui)范性。省(sheng)司法(fa)(fa)行(xing)政(zheng)部(bu)門要及時做好鄉鎮(zhen)(zhen)(zhen)街(jie)道(dao)賦權涉(she)及法(fa)(fa)規(gui)(gui)規(gui)(gui)章的立改(gai)廢,加(jia)強(qiang)工(gong)(gong)作(zuo)綜(zong)(zong)合(he)(he)協(xie)調(diao)、指導(dao)(dao)推(tui)動(dong)、審(shen)核(he)把關;加(jia)強(qiang)工(gong)(gong)作(zuo)監督(du)(du)檢查,定期(qi)跟蹤評估,將鄉鎮(zhen)(zhen)(zhen)街(jie)道(dao)開展行(xing)政(zheng)執(zhi)(zhi)法(fa)(fa)工(gong)(gong)作(zuo)情況納(na)入(ru)(ru)行(xing)政(zheng)執(zhi)(zhi)法(fa)(fa)綜(zong)(zong)合(he)(he)管理監督(du)(du)平臺、納(na)入(ru)(ru)行(xing)政(zheng)執(zhi)(zhi)法(fa)(fa)統(tong)(tong)計(ji)年(nian)報、納(na)入(ru)(ru)法(fa)(fa)治政(zheng)府建設(she)考評指標(biao)體系;根據(ju)實際需要,統(tong)(tong)一規(gui)(gui)范執(zhi)(zhi)法(fa)(fa)文書樣式、行(xing)政(zheng)執(zhi)(zhi)法(fa)(fa)證(zheng)件、執(zhi)(zhi)法(fa)(fa)服(fu)裝和標(biao)志標(biao)識;指導(dao)(dao)各縣(市、區)制(zhi)定鄉鎮(zhen)(zhen)(zhen)街(jie)道(dao)綜(zong)(zong)合(he)(he)行(xing)政(zheng)執(zhi)(zhi)法(fa)(fa)工(gong)(gong)作(zuo)流程(cheng)(cheng)和標(biao)準(zhun)。省(sheng)數據(ju)資源(政(zheng)務(wu)(wu)服(fu)務(wu)(wu))部(bu)門要會(hui)同省(sheng)有關部(bu)門加(jia)強(qiang)對鄉鎮(zhen)(zhen)(zhen)街(jie)道(dao)承接審(shen)批事(shi)項政(zheng)務(wu)(wu)服(fu)務(wu)(wu)工(gong)(gong)作(zuo)的指導(dao)(dao),將其納(na)入(ru)(ru)政(zheng)務(wu)(wu)服(fu)務(wu)(wu)地圖(tu),依托全國一體化政(zheng)務(wu)(wu)服(fu)務(wu)(wu)平臺,及時調(diao)整(zheng)(zheng)系統(tong)(tong)端口(kou)和權限,做到“一網通辦”;依托全國一體化在(zai)線監(jian)管平臺(tai),將鄉鎮街道(dao)承接(jie)執法事(shi)項納(na)入“互聯網+監管”平臺。省有(you)關部門要加強(qiang)對(dui)本系統(tong)涉及鄉鎮街(jie)道賦(fu)(fu)權工(gong)(gong)作(zuo)(zuo)的業(ye)務指(zhi)導,推動完善執(zhi)法程序、嚴(yan)格執(zhi)法責(ze)任(ren)(ren),督(du)促制(zhi)定完善事(shi)前事(shi)中事(shi)后監管(guan)(guan)措施,實(shi)現全(quan)鏈條監管(guan)(guan),堅決防(fang)止放(fang)(fang)管(guan)(guan)脫節(jie)、一(yi)放(fang)(fang)了之(zhi)。各(ge)市(shi)人民(min)政(zheng)(zheng)府要加強(qiang)組織領(ling)導,做(zuo)好(hao)統(tong)籌(chou)協(xie)調,督(du)促所(suo)轄縣(市(shi)、區(qu))做(zuo)好(hao)賦(fu)(fu)權承接(jie)工(gong)(gong)作(zuo)(zuo),統(tong)籌(chou)解決改革中遇到的有(you)關問(wen)題。各(ge)縣(市(shi)、區(qu))人民(min)政(zheng)(zheng)府是(shi)賦(fu)(fu)權承接(jie)工(gong)(gong)作(zuo)(zuo)責(ze)任(ren)(ren)主(zhu)體(ti),要結合本地實(shi)際積(ji)極穩妥做(zuo)好(hao)相(xiang)關工(gong)(gong)作(zuo)(zuo),確(que)保賦(fu)(fu)權事(shi)項放(fang)(fang)得下、接(jie)得住、管(guan)(guan)得好(hao)、有(you)監督(du);要開展鄉鎮街(jie)道承接(jie)事(shi)項運行情(qing)況(kuang)評(ping)估(gu),根據評(ping)估(gu)和(he)《指(zhi)導目錄》動態調整情(qing)況(kuang),結合實(shi)際調整承接(jie)事(shi)項;要根據鄉鎮街(jie)道管(guan)(guan)理體(ti)制(zhi)改革和(he)賦(fu)(fu)權承接(jie)情(qing)況(kuang),按照(zhao)“一(yi)鄉一(yi)策”辦法,制(zhi)定審批(pi)事(shi)項清(qing)單(dan)、行政(zheng)(zheng)執(zhi)法事(shi)項清(qing)單(dan)和(he)配(pei)合事(shi)項清(qing)單(dan),構(gou)建鄉鎮街(jie)道“一(yi)目錄三(san)清(qing)單(dan)”權責(ze)清(qing)單(dan)制(zhi)度(du)體(ti)系。
按照月收集情況、季(ji)度(du)綜合分析(xi)、年度(du)總結(jie)評(ping)估和(he)動態調(diao)整的要求,省(sheng)(sheng)委編辦、省(sheng)(sheng)司(si)法廳會同省(sheng)(sheng)有關部門配套(tao)建立跟蹤(zong)評(ping)估機制(zhi),加強(qiang)統籌協調(diao)指導(dao)和(he)情況通報交(jiao)流(liu),不斷深化(hua)完善鄉(xiang)鎮街道賦權(quan)工作。實施過程中的重大問題及時向省(sheng)(sheng)政(zheng)府報告。
